1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "mutiarotwais" / "we" / "us" / "our" refers to mutiarotwais, a property rental services company operating from 15 Persiaran Gurney, 10250 George Town, Penang, Malaysia.
• "Service" means the property rental matching, management, and related services provided by mutiarotwais.
• "User" / "you" means any individual or entity accessing our website or entering into a rental arrangement with us.
• "Property" means any residential property listed and managed by mutiarotwais.
• "Agreement" means the rental contract entered into between the User and mutiarotwais for the use of a specific Property.
• "Content" means all text, images, and other materials published on our website.

2. Acceptance of Terms

By accessing our website, submitting an enquiry, or entering into a rental Agreement with mutiarotwais, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

You must be at least 18 years of age and have full legal capacity to enter into a binding agreement. By proceeding, you confirm that you meet these requirements.

3. Service Description

mutiarotwais provides a curated property rental service in Penang, Malaysia. Our services include property listing, guest-property matching, tenancy facilitation, and guest support during the rental period. All properties are located within Penang and are made available on monthly rental terms unless otherwise agreed in writing.

Property availability is subject to change. mutiarotwais does not warrant that any specific property will be available at any given time.

4. User Responsibilities

• Provide accurate information when making an enquiry or entering a rental Agreement.
• Use the Property only for lawful residential purposes and in accordance with the conditions of the rental Agreement.
• Respect the property, its contents, and the surrounding environment.
• Not sublet or assign use of the Property without prior written consent from mutiarotwais.
• Notify mutiarotwais promptly of any maintenance issues or damage.
• Comply with any applicable laws, including local by-laws and strata regulations where applicable.
• Not engage in any activity at the Property that causes disturbance to neighbouring residents.

5. Prohibited Uses

The following uses of any mutiarotwais property or website are expressly prohibited:

• Subletting or operating the property as a commercial short-stay accommodation (e.g. Airbnb) without prior written approval
• Conducting any business activity from the property without written consent
• Hosting events or gatherings beyond those agreed in the rental Agreement
• Causing damage, alteration, or modification to the property without consent
• Any illegal activity on the premises

6. Payment Terms

All rental prices are quoted in Malaysian Ringgit (MYR). Payment terms are as follows:

• A refundable security deposit (amount specified in the rental Agreement) is payable prior to move-in.
• Monthly rental is payable in advance, on or before the date specified in the rental Agreement.
• Accepted payment methods will be confirmed at the time of Agreement.
• Late payment may result in additional charges as specified in the rental Agreement.

Refund Policy

Security deposits are returned within 14 days of the end of tenancy, subject to a satisfactory property inspection. Deductions may be made for damage beyond fair wear and tear, unpaid utilities, or other outstanding obligations. We will provide a written account of any deductions made.

7. Rental Agreement Terms

The specific terms of each rental — including duration, included services, property rules, and termination conditions — are set out in the individual rental Agreement signed by both parties. In the event of any conflict between these Terms and Conditions and the rental Agreement, the rental Agreement shall prevail.

8. Intellectual Property

All content on our website — including text, photographs, logos, and design — is owned by or licensed to mutiarotwais. You may not reproduce, distribute, or use any website content for commercial purposes without prior written permission.

9. Disclaimers

Our website and services are provided on an "as is" basis. While we take care in the accuracy of property descriptions and service information, mutiarotwais makes no warranties, express or implied, regarding:

• The uninterrupted availability of the website
• The accuracy or completeness of property listings
• Specific outcomes from your stay

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, mutiarotwais shall not be liable for any indirect, incidental, or consequential loss arising from your use of our services or website, including loss of enjoyment, personal property damage not caused by our negligence, or third-party actions at or near any property.

Our total liability to you in connection with any claim shall not exceed the amount of rent paid by you in the month in which the relevant event occurred.

11. Indemnification

You agree to indemnify and hold harmless mutiarotwais, its staff, and property owners from any claims, losses, or expenses (including legal fees) arising from your breach of these Terms, your use of the Property in an unauthorised manner, or any misrepresentation in information you have provided to us.

12. Termination

Either party may terminate the rental Agreement in accordance with the notice provisions stated within that Agreement. mutiarotwais reserves the right to terminate access to a property with immediate effect in cases of serious breach of these Terms or the rental Agreement, including but not limited to illegal activity or significant property damage.

13. Governing Law & Dispute Resolution

These Terms and any rental Agreement entered into with mutiarotwais are governed by the laws of Malaysia. Any dispute shall be subject to the jurisdiction of the courts of Penang, Malaysia.

Before initiating any formal proceedings, we encourage both parties to attempt informal resolution by contacting us at [email protected]. We aim to respond within 10 business days.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. The revised version will be published on this page with an updated date. Continued use of our services after any change constitutes acceptance of the updated Terms.
